Anatomy of a lawsuit
Illustrated below are the main steps that take place within a lawsuit otherwise known as the legal proceedings.
There are essentialy three phases within the proceedings.
- First, there are motions (a request or application made before the Court).
- Second, there is the fact finding and investigative phase.
- This is known as “Discovery” where for example the plaintiff may choose to “examine” the defendant. In this case, plaintiff’s attorney will ask the defendant questions in the presence of his or her attorney. These questions are asked under oath and before a stenographer.
- The last phase, is a hearing before the Court were your case will be heard.
